A County Durham man has been heavily fined in court after ditching his rubbish in the middle of the road - leaving it impassable for other drivers.
Tekin Kaya, 49, from Chester Le Street, was fined at Peterlee Magistrates on May 23 after failing to comply with a Section 108 notice in relation to waste.
The charge against Kaya related to an order that saw neighbourhood wardens from Durham County Council attend Forge Lane on Auguat 23, 2022, where a large fly tip was left in the middle of the road leaving the road inaccessible for road users until cleared.
Neighbourhood Wardens investigated the waste and found evidence relating to a business in the area of Chester Le Street.
The warden then spoke to the business owner where he stated that he had flagged a caged vehicle down in the street and paid £200 for the waste to be removed.
He stated he did not know the person and the warden had concerns about the checks carried out.
The council's fly tipping team then sent out an official Section 108 Environment Act 1995 Notice requiring the defendant to attend an interview.
He failed to attend this.
The defendant now has fines and costs of £448.70 to pay.
Following the court hearing, Durham County Council has warned residents that if someone collects your waste, you should:
Use a waste company registered with the Environment Agency – ask to see their waste carrier certificate
Keep all paperwork issued by the company
Everyone is responsible for their waste to ensure it is disposed of properly, this is known as “duty of care”. If waste is fly-tipped and traced back to the owner, you could face prosecution and a fine of up to £50,000.
